在您購買任何藝術作品前，請詳細閱讀本條款。當您完成下單或付款，即視為您已同意以下所有規定。

一、 藝術作品之權利歸屬 (智慧財產權)
藝術作品與一般商品不同，購買「實體作品」並不代表取得「著作權」。
  • 著作權保留：除非另有書面協議，否則所有作品之著作人格權與著作財產權（如重製、改作、公開展示權等）均仍歸屬於創作者安爺堂 Anye-Tang 所有。
  • 使用限制：買受人僅取得該實體作品之所有權及私人展示權。未經書面授權，買受人不得將作品進行任何商業性重製（如印製成明信片販售）、數位化散佈或作為企業 Logo 使用。

二、 交易說明與真偽保證
  • 作品呈現：本平台盡力確保照片真實反映作品原貌。但因拍攝光線或螢幕顯色差異，實品與照片可能存在些微色差，此不屬於瑕疵範圍。
  • 真偽保證：本平台保證所售作品皆為創作者原創，並隨附 [作品保證書/簽名證書]。
  • 規格確認：買受人應於下單前確認作品尺寸、材質。

三、 運送與保險
  • 包裝義務：賣方負責以專業藝術品包裝方式確保作品運送安全。
  • 收貨檢查：買受人於簽收時應立即開箱錄影檢查。若發現受損，請於 24 小時內聯繫本平台並提供完整錄影證據。

四、 七天鑑賞期與退換貨政策
  • 通訊交易適用：依據《消費者保護法》，消費者享有收到商品後隔日起算 7 天之猶豫期。
  • 退貨條件：退回作品必須保持「全新原狀」且包裝完整。若因買受人保存不當導致作品受潮、污損或刮傷，將影響退貨權利或須負擔折價損失。
  • 例外情況：依據消費者要求進行之客製化創作（如人像委託繪製），屬於消保法規定之合理例外情事，不適用 7 天無理由退貨。
五、 免責聲明與管轄
  • 不可抗力：因天災、戰爭或政府法令等不可抗力導致延遲出貨，本平台不負違約責任。
  • 準據法：本協議以中華民國法律為準據法。
  • 管轄法院：因本協議產生之爭議，雙方合意以臺灣臺北地方法院為第一審管轄法院。

 

By purchasing any artwork, you acknowledge that you have read, understood, and agreed to the following terms.

1. Intellectual Property Rights
Purchasing a physical artwork does not grant the buyer any copyrights.
  • Retention of Rights: Unless otherwise agreed in writing, Anye-Tang retains all copyrights to the artwork, including the right to reproduce, modify, and distribute images of the work.
  • Usage Restrictions: The Buyer acquires ownership of the physical piece and the right to private display only. Any commercial reproduction, digital distribution, or use of the artwork in corporate branding is strictly prohibited without prior written consent.

2. Product Authenticity and Representation
  • Visual Accuracy: We strive to represent the colors and details of the artworks as accurately as possible. However, please note that actual colors may vary slightly due to lighting conditions or monitor settings.
  • Certificate of Authenticity: All original artworks are guaranteed to be authentic and will be accompanied by a Certificate of Authenticity (COA) signed by the artist.

3. Shipping and Liability
  • Packaging: The Artist/Platform is responsible for professional-grade packaging to ensure the safety of the artwork.
  • Inspection: The Buyer must inspect the package upon arrival. If any damage is found, please record an unboxing video and contact us within 24 hours with photographic evidence.

4. Returns and Refunds 
  • General Artworks: In accordance with consumer protection laws (where applicable), Buyers may have a 7-day cooling-off period to return the work. The artwork must be returned in its original, pristine condition and original packaging. The Buyer is responsible for return shipping costs and insurance.
  • Custom/Commissioned Works: Per the "reasonable exceptions" for personalized goods, custom-made or commissioned artworks are non-refundable and cannot be returned unless they arrive damaged.
5. Governing Law and Jurisdiction
  • Governing Law: This agreement shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan).
  • Dispute Resolution: Any disputes arising from this agreement shall be submitted to the jurisdiction of the Taipei District Court.
